The DUI charge and allegations that occurred last November during the BYU basketball season against Kennard Davis Jr. have been dismissed, according to the Deseret News.

Jay Drew of the Deseret News spoke with the Provo City Attorney’s Office and Davis Jr.’s attorney, Danny Frazier, confirming that the charges were dropped due to “lack of evidence” after a toxicology report was released.

“The reasoning was that by Utah law, they didn’t have evidence of a DUI,” Frazier told the Deseret News. “There was no impairing substance in his system, nothing under Utah law that’s considered an impairing substance. No alcohol … no THC, no other prescription drugs, nothing like that.”

Davis missed two games in November due to what BYU basketball head coach Kevin Young called a “violation of team rules.” He missed BYU’s games against eventual national runner-up UConn in Boston and against Wisconsin at the Delta Center.

Those two games followed the two-car crash in a Provo intersection that Davis’ car was involved in last November.

Davis returned to the floor on Thanksgiving night against the Miami Hurricanes, returning to the starting lineup and scoring 18 points in the win. The St. Louis, Missouri native remained in the starting lineup for the remainder of BYU’s season after that.

Davis averaged 8.5 points, 2.7 rebounds, and 1.3 assists this past season for BYU.

He is currently in the NCAA Transfer Portal, and as of Wednesday, has not announced a new landing spot.

After the BYU basketball season concluded, following an NCAA Tournament loss to Texas, Davis was asked by KSL Sports how he’d assess his year at BYU, said, “I feel like I made the right decision. It was ups and downs, obviously, but it’s a great coaching staff, great players. So I feel like everything was as expected.”
